Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and TryMe, Corp ("TryMe", "we", "us", "our") governing your use of TryMe, a try-before-you-buy sampling platform for clean-beauty products (the "Service"). Please also review our Privacy Policy, which is incorporated into these Terms.
1. Acceptance of these Terms
By creating an account, claiming a sample, writing a review, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use TryMe. We may update these Terms as described in the "Changes to these Terms" section below.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using TryMe, you represent that you meet this requirement and that the information you provide is accurate.
3. Your account
Authentication is handled by our identity provider, Clerk. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information, including a valid shipping name and address when claiming physical samples and a valid phone number when claiming digital samples. Notify us promptly of any unauthorized use of your account.
4. The sampling service
Samples offered through TryMe are provided free of charge and carry no obligation to purchase anything, the whole point is to try before you buy. Samples are offered per brand campaign, while supplies last, and are subject to eligibility and skin-matching criteria. Availability is not guaranteed, and we may limit, decline, or cancel claims to keep campaigns fair.
5. One claim per campaign and anti-abuse
To keep sampling fair for everyone, the following rules apply:
- You may hold one account. Creating multiple accounts, or using multiple addresses or phone numbers, to claim extra samples is prohibited.
- You may generally claim a given sample once per campaign.
- Reselling free samples or digital redemption codes is prohibited.
- Using bots, scripts, or other automated means to claim samples is prohibited.
We may verify addresses and phone numbers, and we may refuse, revoke, or cancel claims and suspend or terminate accounts where we suspect abuse or violation of these Terms.
6. Honest reviews
Reviews are the heart of TryMe, and they must be genuine. When you write a review, you agree that:
- Your review is genuine, based on your own actual experience with the sample, and reflects your honest opinion.
- You understand that samples are provided free. We do not pay for reviews, and we do not condition any reward on writing a positive review.
- You will comply with applicable advertising and consumer-protection rules, including U.S. FTC guidance on endorsements and reviews.
You grant TryMe and the relevant brand a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and syndicate your reviews, together with your skin-type tag and no other personally identifiable information. We may remove reviews that are fake, off-topic, unlawful, or otherwise in violation of these Terms.
7. Skincare disclaimer
Samples and reviews on TryMe are not medical or professional skincare advice. Cosmetic and skincare products can cause reactions. Always patch-test before use, review ingredient lists for allergens or ingredients you are sensitive to, and discontinue use if irritation occurs. Consult a qualified professional for concerns about your skin.
8. Brand and business users
Brands that use the platform, including to run campaigns, supply samples, and pay via invoice or billing, do so under a separate brand agreement. Those terms govern the brand relationship and are in addition to these Terms.
9. Intellectual property
The TryMe name, logo, website, application, and content are owned by TryMe or its licensors and are protected by intellectual-property laws. Except for the rights expressly granted in these Terms, we do not grant you any right, title, or interest in the Service or its content.
10. User content
You retain ownership of the reviews and other content you submit ("User Content"), subject to the license you grant in the "Honest reviews" section above. You are responsible for your User Content and represent that you have the rights to submit it and that it does not violate any law or the rights of others.
11. Acceptable use
You agree not to misuse the Service, including by: violating any law; infringing others' rights; submitting false, misleading, or fraudulent information; interfering with or attempting to gain unauthorized access to the Service or its systems; or engaging in the abuse described in the "Anti-abuse" section above.
12. Third-party links
The Service may contain links to brands, retailers, or other third-party sites and services. We do not control and are not responsible for third-party sites, and your use of them is governed by their own terms and privacy policies.
13. Disclaimers
The Service and all samples are provided "as is" and "as available", without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any sample will be available.
14. Limitation of liability
To the fullest extent permitted by law, TryMe and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service or any sample obtained through it. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless TryMe and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.
16. Termination
You may stop using TryMe at any time. We may suspend or terminate your access if you violate these Terms or to protect the platform and its users. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
17. Governing law
These Terms are governed by the laws of Virginia, without regard to its conflict-of-laws rules. You and TryMe agree to the exclusive jurisdiction and venue of the courts located in Virginia for any dispute not subject to another agreed dispute-resolution process.
18. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
